Leaked ICE Memo sent by the DHS is telling ICE Agents they can enter homes without a court warrant. This is a crazy piece of information that luckily has been brought to the public’s attention, thanks to an ICE whistle blower. This Memo affects us all and could make anybody the target of an ICE raid for no reason.
The memo in question is a memorandum for May 12th, 2025 called “The May 12 Memo”. The memo was created and sent out by the acting head of ICE, Todd Lyons. The memo was addressed to “all ICE personnel,” but instead it was only sent to specific DHS officials, who were directed to verbally brief their new policy for action. DHS officials would give the agents to read over themselves. By doing this, they would target specific Agents who had questions, and didn’t know what they were legally allowed to do when entering homes.
In the Memo, new ICE agents and ones who were unaware of the law were told by the director of ICE to,“ Forcibly enter into certain people’s homes without a judicial warrant, consent, or an emergency. ” This directly goes against the fourth amendment (right … against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause.) This goes against your right for not being randomly raided by the police for no reason.
The problem with this Memo is that it has caused ICE agents to think what they are doing is legal, this is still completely illegal. This brings up many questions, when an ICE agent breaks the fourth amendment after being told this is he able to be held accountable, or is Todd Lyons accountable? While we don’t know the answer to that question, it is very possible that he would be.
Now this brings up another question, has this ever happened before? Yes, ICE agents have broken the fourth amendment thinking that they were following the law. “On June 12, 2025, ICE raided the home of a pregnant U.S. citizen in Huntington Park, California ICE officers approached the mother’s residence with a warrant for her husband… She explained that her husband was gone, and watched as ten heavily armed ICE officers swept in to search her home. This shows major government oversight that allowed ICE to raid a pregnant woman’s home.
